Terms of Service

Skin Intelligence is a cosmetic skincare analysis tool that provides appearance-based skin metrics, scores, and routine suggestions for personal cosmetic use only.

The platform also offers My Shelf, an optional feature that uses AI to read the labels of cosmetic products you photograph, so you can keep track of what you own and see how it relates to your suggested routine.

This platform is not a medical device and does not provide medical diagnosis, treatment recommendations, or clinical advice. It is not a substitute for professional dermatological or medical consultation.

You must be at least 18 years of age to create an account and use this platform. By creating an account, you confirm that you meet this age requirement.

Skin Intelligence is not available to residents of the States of Illinois or Washington, or the province of Quebec. By creating an account, you represent that you are not a resident of Illinois, Washington, or Quebec. Accounts identified as belonging to residents of Illinois, Washington, or Quebec will be deactivated. You agree not to use a VPN, proxy, or any other means to disguise or misrepresent your location in order to access the Service from a location where it is not offered.

You agree to provide accurate and complete information when creating your account and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

Skin Intelligence offers two plans: Discover (free) and Pro ($9.99/month, or $83.90/year — an annual plan billed once yearly, which works out to $6.99/month — charged in your local currency, plus applicable taxes, as shown at checkout), which includes daily skin scanning. New Discover accounts start with 5 skin scans and 25 product-label scans as an introductory offer (subject to our anti-abuse eligibility checks); we may change or withdraw this introductory offer at any time. Once these introductory scans are used, skin scanning and product-label scanning require a Pro subscription. Pro includes daily skin scanning, our most advanced analysis, and product-label scanning; your personalized routine, trends, and the rest of the app are available on both plans.

Subscriptions auto-renew at the end of each billing period — monthly plans renew each month and annual plans renew each year. For subscriptions purchased through the Apple App Store, payment is charged to your Apple Account at confirmation of purchase; cancel at least 24 hours before renewal, as required by Apple — your payment method may be charged up to 24 hours before the start of the next billing period. For subscriptions purchased through Google Play, cancel before the renewal date. For subscriptions purchased on the web (Stripe), you can cancel any time before your renewal date and you will not be charged again. Subscriptions are managed via Apple App Store (iOS), Google Play Store (Android), or Stripe (web). In-app purchases must use the respective platform billing system. For subscriptions purchased on the web (Stripe), we will send you a reminder at least once each year — and before each annual renewal — identifying your subscription, the amount and frequency of the charge, and how to cancel; for store purchases, the respective app store provides renewal notices.

To cancel: if you subscribed through the Apple App Store or Google Play, cancel in your store subscription settings. If you subscribed on the web (Stripe), you can cancel any time from Profile → Manage Plan → Cancel Subscription, or contact us at support@skinintelligence.ai. Cancellation takes effect at the end of your current billing period — you retain access until then. Where your local law requires, you may also cancel an annual subscription after it has renewed and receive a pro-rata refund of the unused portion of the renewed term, paid within 15 days.

The Pro plan provides daily scanning for personal use, subject to a fair-use limit of 100 scans per month — on annual plans, this limit refreshes each month of your subscription — to prevent automated abuse. This limit is not a feature restriction and is not reached through normal personal use. Failed or incomplete scans do not count toward this limit. Product-label (My Shelf) scanning is likewise subject to fair-use limits — 100 label scans per day and 250 per month — to prevent automated abuse; these are not feature restrictions and are not reached through normal personal use. Failed or refused reads do not use up your introductory label scans, though they do count toward these anti-abuse limits. If we increase the price of your subscription, we will give you advance notice 30 days before the change takes effect, including the new price and how to cancel before it takes effect. Where your local law requires a different notice window, additional content, or the right to keep your current terms or to cancel with a refund, we will follow it. Where required by your local law, you will be able to cancel within at least 14 days of the first charge at the new price and receive a pro-rata refund of the remaining term. For purchases made through the Apple App Store or Google Play, refunds are handled by that store under its own policies. For purchases made on the web through Stripe, Skin Intelligence is the seller: cancelling stops your next charge and you keep access until the end of the period you have already paid for, and — apart from the refunds described in these Terms and any refund required by the consumer law of your place of residence — amounts already paid are not refunded. Where a refund is due from us (web purchases via Stripe), we will send it to your original payment method within 15 days.

If we discontinue the Service, we will provide reasonable advance notice and refund the unused, prepaid portion of your subscription term, or provide equivalent continued access, subject to the refund processes of your billing platform (Apple App Store, Google Play Store, or Stripe).

You may use this platform solely for personal, non-commercial cosmetic skincare analysis. You agree not to use the platform for any unlawful purpose or in any manner that could damage, disable, or impair the service.

You may not attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of the platform, including its AI models and analysis methods.

All content, features, and functionality of the Skin Intelligence platform — including its design, software, AI models, text, graphics, and trademarks — are owned by Skin Intelligence Inc. and are protected by applicable intellectual property laws.

You retain full ownership of the facial images you capture through the platform. When you initiate a scan, your photo is transmitted to Skin Intelligence servers for transient processing only, then forwarded to our AI analysis providers (OpenAI and Google) for the sole purpose of generating your skin analysis results. Photos are held in server memory during analysis and are immediately discarded — they are never stored, logged, or retained on Skin Intelligence servers; our AI providers do not use the image for training and, under the zero-retention terms we have enabled, do not log or retain it for abuse monitoring — an image is kept only where a child-safety system flags it, or where required by law, as described in our Privacy Policy. Your scan photos remain stored on your device only, unless you enable optional cloud backup to your personal iCloud or Google Drive.

Skin Intelligence may use aggregated, de-identified usage data (such as feature-usage statistics) to improve the Service. We do not use your facial images, or any data derived from your facial images or camera input, to train AI models.

Feedback — If you send us suggestions or feedback, you grant us a non-exclusive, royalty-free license to use them to improve the Service.

This platform provides cosmetic appearance analysis only. Skin scores and metrics are generated by AI models; routine suggestions are generated by a rule-based algorithm using those scores and your preferences. All are intended for informational and cosmetic purposes only.

Skin Intelligence Inc. does not guarantee the accuracy, completeness, or reliability of any analysis results. Results should not be used as a basis for medical decisions. The platform is provided "as is" without warranties of any kind, whether express or implied.

My Shelf label reading is AI-assisted and provided on a best-effort basis. Product details read from your photos — brand, name, category, and ingredient list — may contain errors or omissions and are presented to you for review and correction before saving. Shelf information, including ingredient lists and routine-fit indicators, is cosmetic guidance only. Always rely on the product's actual packaging and label — especially for ingredient, allergen, usage, and safety information — and consult a qualified professional for any medical or allergy concern.

Product Suggestions & Affiliate Links — The platform may show sample or suggested cosmetic products for your convenience. These are illustrative examples, not endorsements or guarantees, and we do not sell them. Some links to third-party retailers are affiliate links, from which we may earn a commission if you make a purchase, at no extra cost to you; this never affects which products are suggested to you, which are generated by our rule-based algorithm. Any purchase is between you and the retailer, and we are not responsible for third-party products, websites, prices, availability, or fulfilment.

To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties; nothing in these Terms excludes or limits any warranty or right that cannot be excluded under applicable consumer law.

To the maximum extent permitted by applicable law, Skin Intelligence Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the platform.

In no event shall our total liability exceed the greater of (a) the amount you have paid to Skin Intelligence Inc. in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty United States dollars (US$50).

Nothing in this section excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited under applicable law.

To the extent permitted by applicable consumer law, you agree to indemnify and hold harmless Skin Intelligence Inc. from any third-party claims arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.

We may suspend or terminate your access if you breach these Terms (including the age, Illinois-, Washington- and Quebec-residency, acceptable-use, or fair-use provisions), engage in fraud or abuse, or where required by law. On termination, your right to use the Service ends.

Provisions that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will continue in effect. If we terminate a paid subscription other than for your breach, we will refund the unused, prepaid portion of your term, subject to your billing platform's processes.

We may update these Terms from time to time. For material changes we will give you reasonable advance notice in-app or by email and, where required, ask you to re-accept before you continue using the Service. If you do not agree to a material change, you may stop using the Service and cancel your subscription; if the change is adverse to you, we will refund the unused, prepaid portion of your current term, subject to your billing platform's refund processes. Non-material changes take effect when posted, shown by the updated version date below; we will notify you of the change in-app or by email.

These Terms of Service are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in the Province of British Columbia, Canada, except that you may bring an individual claim in the small claims court of your place of residence if it qualifies there, and except as otherwise provided below.

Nothing in these Terms limits any mandatory consumer-protection right, or any right to bring or join a class proceeding, that you have under the law of your place of residence.

App Store Terms — If you obtain the app or a subscription through the Apple App Store or Google Play, your use and purchase are also subject to that store's terms, and the relevant store handles billing, renewals, and refunds for store purchases.

Apple App Store — Additional Terms (iOS) — The following applies when you download or use the app on an Apple device. These Terms are between you and Skin Intelligence Inc. only, not Apple, and Apple is not responsible for the app or its content. Your license to use the app is a non-transferable license to use it on any Apple-branded products you own or control, as permitted by the App Store Usage Rules. Apple has no obligation to provide any maintenance or support for the app; support is provided solely by Skin Intelligence Inc. at support@skinintelligence.ai. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the app's purchase price to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are the sole responsibility of Skin Intelligence Inc. Skin Intelligence Inc., not Apple, is responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including product-liability claims, any claim that the app fails to meet a legal or regulatory requirement, and claims under consumer-protection law. If a third party claims that the app or your use of it infringes that third party's intellectual-property rights, Skin Intelligence Inc., not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim. You must comply with any applicable third-party terms when using the app. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and that Apple may enforce these Terms against you as a third-party beneficiary.

Eligibility and Sanctions — You represent that you are not located in or a resident of any country or region subject to comprehensive economic sanctions, and that you are not on any restricted-party list. The Service is offered only in the United States (excluding Illinois and Washington) and Canada (excluding Quebec); we do not offer, market, or direct it to any other jurisdiction, including the European Union or the United Kingdom.

Entire Agreement — These Terms, together with the Privacy Policy, the Biometric Data Policy, and the Consumer Health Data Privacy Policy, are the entire agreement between you and us regarding the Service, without limiting any non-excludable consumer rights.

Accessibility — We want Skin Intelligence to be usable by everyone and are working to align the Service with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. Accessibility is an ongoing effort, and some parts of the Service may not yet fully conform. If you have difficulty accessing any part of the Service, or need any content in a different format, contact us at support@skinintelligence.ai and we will do our best to help.

No Waiver — Our failure to enforce any provision is not a waiver of that provision.

Assignment — You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or asset sale, on notice to you.

Force Majeure — We are not liable for any failure or delay caused by events beyond our reasonable control, including cloud, AI-provider, or payment-infrastructure outages.

Severability — If any provision of these Terms is held unenforceable, that provision is severed and the remaining provisions remain in full effect.
