Terms of Service

Skin Intelligence is a cosmetic skincare app. It gives appearance-based skin scores and routine suggestions for personal cosmetic use. It also offers My Shelf, which reads the labels of cosmetic products you photograph so you can keep track of what you own, and Pick, which reads a cosmetic product from your photos and shows how well it fits your skin profile.

Skin Intelligence is not a medical device. It does not provide medical diagnosis, treatment recommendations or clinical advice, and it is not a substitute for professional dermatological or medical consultation.

By creating an account, you agree to these Terms and to our Privacy Policy.

You must be at least 18 years old to create an account and use Skin Intelligence. By creating an account, you confirm that you are.

Skin Intelligence is offered only in the territories listed in Section 12 (Availability), and not to residents of Illinois, Washington or Quebec. By creating an account, you represent that you live in a listed territory and are not a resident of Illinois, Washington or Quebec; an account we identify as breaching this will be deactivated. You agree not to use a VPN, proxy or any other means to disguise or misrepresent your location in order to use the service from a place where it is not offered.

You agree to give accurate and complete information when creating your account and to keep your sign-in secure. You are responsible for all activity under your account.

Plans

Skin Intelligence has two plans: Discover (free) and Pro (paid, billed monthly or annually; the annual plan is billed once each year at a lower effective monthly rate). Prices are shown in your local currency and may differ by territory; the price you see before you confirm is the price you pay. Pro adds daily skin scanning and our most advanced analysis; your routine, trends, product-label scanning and the rest of the app are on both plans.

New Discover accounts start with 5 skin scans as an introductory offer, and Discover includes up to 20 product-label scans a day, both subject to our anti-abuse eligibility checks. We may change or withdraw either offer at any time. Once the introductory scans are used, skin scanning requires Pro.

Where You Buy

Outside the United States and Canada, subscriptions are sold only through the Apple App Store and Google Play; our web checkout (Stripe) is available only in the United States and Canada. For a store purchase, Apple or Google is the seller and handles billing, taxes, renewals and refunds under its own terms.

Renewal

Subscriptions renew automatically at the end of each monthly or annual period until you cancel. App Store: payment is charged to your Apple Account when you confirm the purchase, you may be charged up to 24 hours before the next period begins, and you must cancel at least 24 hours before renewal. Google Play: cancel before the renewal date. Web (Stripe): cancel any time before your renewal date and you will not be charged again; we remind you at least once a year, and before each annual renewal, of your subscription, the amount and frequency of the charge, and how to cancel. The app stores send their own renewal notices.

Canceling and Refunds

Cancel a store subscription in your App Store or Google Play settings, and a web subscription from Manage Plan in your Profile or by emailing support@skinintelligence.ai. Cancellation takes effect at the end of your current billing period, and you keep access until then.

Store purchases are refunded by the store under its own policies. For web purchases, Skin Intelligence is the seller, and amounts already paid are not refunded except as these Terms or the consumer law where you live require. Where your local law requires, you may cancel an annual subscription after it renews and receive a pro-rata refund of the unused part. Any refund due from us is sent to your original payment method within 15 days.

Brazil — If you are resident in Brazil, Article 49 of the Consumer Defense Code (Law No. 8.078/1990) gives you seven days from the day you subscribe to withdraw from a contract made away from our commercial establishment and receive everything you paid, monetarily adjusted. Store subscriptions are refunded through the store; if we sell to you directly on our website, email support@skinintelligence.ai within those seven days for a full refund.

Price changes — If we raise your subscription price, we will tell you at least 30 days before it takes effect, with the new price and how to cancel. Where your local law requires, you may cancel within at least 14 days of the first charge at the new price and receive a pro-rata refund of the remaining term.

If we discontinue the service, we will give you reasonable advance notice and refund the unused, prepaid part of your subscription, or provide equivalent continued access, subject to your billing platform's refund process.

Fair Use

To prevent automated abuse, Pro skin scanning has a fair-use limit of 100 scans a month (refreshing each month on annual plans), and product-label scanning is limited to 100 a day on Pro and 600 a month on either plan. Normal personal use does not reach these limits. Failed or incomplete skin scans do not count, and a failed or refused label read counts toward the monthly label limit only.

You may use Skin Intelligence only for personal, non-commercial cosmetic skincare. You agree not to use it for any unlawful purpose or in any way that could damage, disable or impair the service, and not to reverse engineer, decompile, disassemble or otherwise try to derive its source code or underlying algorithms, including its AI models and analysis methods.

Skin Intelligence — its design, software, analysis methods, text, graphics and trademarks — is owned by Skin Intelligence Inc. and protected by intellectual property law.

You keep full ownership of the photos you take. We do not use your face photos, or any data derived from them or from your camera, to train AI models. We may use aggregated, de-identified usage data, such as feature-usage statistics, to improve the service.

If you send us suggestions or feedback, you grant us a non-exclusive, royalty-free license to use them to improve the service.

Skin Intelligence provides cosmetic appearance analysis only. Skin scores are generated by AI models, and routine suggestions by a rule-based algorithm using those scores and your preferences; all are for informational and cosmetic purposes only. We do not guarantee the accuracy, completeness or reliability of any result, and results should not be used for medical decisions.

My Shelf label reading and Pick results are AI-assisted and provided on a best-effort basis. Product details read from your photos may contain errors or omissions and, in My Shelf, can be reviewed and corrected. Shelf information and Pick results — including ingredient lists, ingredient functions, routine-fit indicators and match scores — are cosmetic guidance only. Always rely on the product's own packaging and label, especially for ingredient, allergen, usage and safety information, and consult a qualified professional for any medical or allergy concern.

Open-data product information — Some product names and ingredient lists come from Open Beauty Facts, a community-maintained database that may be incomplete, outdated or incorrect, so check the product's printed ingredient list before relying on it. That source data remains available under ODbL 1.0, with individual contents under DbCL 1.0; those licenses, not these Terms, govern it. Pick's scores and explanations are Skin Intelligence's own output.

Product suggestions and affiliate links — We may show sample or suggested cosmetic products. They are illustrative examples, not endorsements or guarantees, and we do not sell them. Some links to retailers are affiliate links, from which we may earn a commission at no extra cost to you; commissions never affect how our rule-based algorithm matches products to you. Any purchase is between you and the retailer, and we are not responsible for third-party products, websites, prices, availability or fulfilment.

The service is provided "as is", without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties; nothing in these Terms excludes or limits any warranty or right that cannot be excluded under applicable consumer law.

To the maximum extent permitted by applicable law, Skin Intelligence Inc. is not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising out of or related to your use of the service.

Our total liability will not exceed the greater of (a) the amount you paid Skin Intelligence Inc. in the twelve (12) months before the event giving rise to the claim, or (b) fifty United States dollars (US$50).

Nothing in this section excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited under applicable law.

Your rights under local consumer law — Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy that the consumer law of your country or state gives you and that cannot lawfully be excluded, restricted or modified — including the consumer guarantees of the Australian Consumer Law and the rights given by Brazil's Consumer Defense Code. Our disclaimers in Section 6 and this limitation apply only so far as that law allows.

To the extent permitted by applicable consumer law, you agree to indemnify and hold harmless Skin Intelligence Inc. from any third-party claims arising out of your misuse of the service, your breach of these Terms, or your violation of any law or the rights of a third party.

We may suspend or end your access if you breach these Terms (including the age, residency, availability, acceptable-use or fair-use provisions), engage in fraud or abuse, or where the law requires. When your access ends, your right to use the service ends.

Provisions that by their nature should survive — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification and Governing Law — continue in effect. If we end a paid subscription other than for your breach, we will refund the unused, prepaid part of your term, subject to your billing platform's process.

We may update these Terms. For material changes, we will give you reasonable advance notice in the app or by email and, where required, ask you to accept them again before you continue using the service. If you do not agree to a material change, you may stop using the service and cancel your subscription; if the change is adverse to you, we will refund the unused, prepaid part of your current term, subject to your billing platform's refund process. Other changes take effect when posted, shown by the updated version date below, and we will tell you about them in the app or by email.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law principles.

Disputes arising under or in connection with these Terms are subject to the exclusive jurisdiction of the courts of British Columbia, Canada, except that you may bring an individual claim in the small claims court where you live if it qualifies there.

Before starting a formal proceeding, please write to us at support@skinintelligence.ai and give us 30 days to put the problem right. This is a request, not a condition: it does not stop you from going to court, bringing a small claim, or exercising any right your local law gives you.

Nothing in these Terms limits any mandatory consumer-protection right, or any right to bring or join a class proceeding, that you have under the law of where you live.

Apple App Store — Additional Terms (iOS) — The following applies when you download or use the app on an Apple device. These Terms are between you and Skin Intelligence Inc. only, not Apple, and Apple is not responsible for the app or its content. Your license to use the app is a non-transferable license to use it on any Apple-branded products you own or control, as permitted by the App Store Usage Rules. Apple has no obligation to provide any maintenance or support for the app; support is provided solely by Skin Intelligence Inc. at support@skinintelligence.ai. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the app's purchase price to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are the sole responsibility of Skin Intelligence Inc. Skin Intelligence Inc., not Apple, is responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including product-liability claims, any claim that the app fails to meet a legal or regulatory requirement, and claims under consumer-protection law. If a third party claims that the app or your use of it infringes that third party's intellectual-property rights, Skin Intelligence Inc., not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim. You must comply with any applicable third-party terms when using the app. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and that Apple may enforce these Terms against you as a third-party beneficiary.

Availability — The service is offered only in: Australia, Brazil, Brunei Darussalam, Canada (excluding Quebec), Georgia, Hong Kong SAR, India, Japan, Jordan, Kenya, Kuwait, Namibia, Singapore, South Korea, Trinidad and Tobago, Ukraine, the United Arab Emirates, and the United States (excluding Illinois and Washington). We do not offer, market or direct it to any other jurisdiction, including the European Union and the United Kingdom. Within this list, the service becomes available in a territory once it is listed in that territory's App Store or Google Play storefront.

Sanctions — You represent that you are not located in or a resident of any country or region subject to comprehensive economic sanctions, and that you are not on any restricted-party list.

Entire Agreement — These Terms, together with the Privacy Policy, the Biometric Data Policy and the Consumer Health Data Privacy Policy, are the entire agreement between you and us regarding the service, without limiting any consumer rights that cannot be excluded.

Accessibility — If you have difficulty using any part of the service, or need content in a different format, contact support@skinintelligence.ai and we will do our best to help.

No Waiver — If we do not enforce a provision, that is not a waiver of it.

Assignment — You may not assign these Terms without our consent. We may assign them to an affiliate, or in connection with a merger, acquisition or asset sale, on notice to you.

Force Majeure — We are not liable for any failure or delay caused by events beyond our reasonable control, including cloud, AI-provider or payment-infrastructure outages.

Severability — If any provision is held unenforceable, it is severed and the rest remain in full effect.
